2.3 Age Restriction

4. Orders & Payment

4.1 Order Acceptance

Placing an order constitutes an offer to purchase. We reserve the right to accept, decline, or cancel any order at our discretion, including but not limited to cases of pricing errors, product unavailability, or suspected fraudulent activity. You will be notified via email if your order is cancelled.

4.2 Pricing

All prices are listed in U.S. dollars and are subject to change without notice. Promotional pricing and discounts are valid only during the specified promotional period. We reserve the right to correct pricing errors, even after an order has been placed.

4.3 Payment

We accept major credit cards, debit cards, and other payment methods as displayed atcheckout. By providing payment information, you represent that you are authorized to use thepayment method. All transactions are encrypted and processed through secure third-party payment processors.

4.4 Subscription Orders

If you enroll in a subscription program, you authorize House of Evolution Nutrition to charge your payment method on a recurring basis at the frequency selected. You may cancel your subscription at any time by contacting our customer service team at least 48 hours before the next billing date.

5. Shipping & Delivery

We ship to addresses within the United States and select international destinations. Shipping times are estimates and are not guaranteed. House of Evolution Nutrition is not responsible for delays caused by carriers, customs, weather, or other factors outside our control. Risk of loss and title for products passes to you upon delivery to the carrier.

6. Returns & Refunds

6.1 Return Policy

We want you to be satisfied with your purchase. If you are not completely satisfied, you may return unopened, unused products in original packaging within 30 days of delivery for a full refund of the purchase price, excluding shipping costs.

6.2 Non-Returnable Items

The following items are not eligible for return:

Opened or partially used products
Items marked as final sale or non-returnable
Products not in their original packaging
Items purchased through unauthorized third-party retailers

6.3 How to Initiate a Return

To initiate a return, contact our customer service team with your order number and reason for return. We will provide return shipping instructions. Refunds will be processed within 7–10 business days of receiving the returned item.

7. Intellectual Property

All content on our website and in our marketing materials, including but not limited to text, graphics, logos, product names, images, and software, is the exclusive property of House of Evolution Nutrition or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without our prior written permission. Unauthorized use of our intellectual property is strictly prohibited and may result in legal action.

8. User Conduct

When using our website or services, you agree not to:

Our total liability to you for any claims arising under these Terms shall not exceed the total amount paid by you for the products or services giving rise to the claim in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

OUR PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR PRODUCTS WILL MEET YOUR SPECIFIC HEALTH GOALS OR EXPECTATIONS.

12. Indemnification

You agree to indemnify, defend, and hold harmless House of Evolution Nutrition and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of our products or services, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law & Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law provisions.

13.2 Arbitration

Any dispute arising out of or relating to these Terms or our products and services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in Lincoln Nebraska. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13.3 Small Claims Court

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court’s jurisdiction.

14. Changes to Terms

We reserve the right to update or modify these Terms at any time at our sole discretion. We will notify you of material changes by posting the updated Terms on our website with a new effective date. Your continued use of our products or services after such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

15. Termination

We reserve the right to suspend or terminate your access to our website, services, or subscription programs at any time, with or without cause, and with or without notice. Upon termination, all provisions of these Terms that by their nature should survive will continue to apply, including intellectual property rights, disclaimers, and limitations of liability.
